If, as Political Liberals tell us, one cannot support a law that limits another’s fundamental or basic liberty if one’s reasons for the law are reasons that may be reasonably rejected by those who would be coerced, punished, or marginalized by the law, then legalizing same-sex marriage would be unjust. But, according to the Political Liberal, not legalizing same-sex marriage is unjust as well. So, given the internal structure of the legal systems and the nature of the judiciary (and in some cases, Constitutional Law) in liberal democracies, the only way for the Political Liberal to extricate himself from this predicament is either to cease being a Political Liberal or to abandon his support for same-sex marriage.
